1. Agreement to Terms
By accessing or using RentBhai's property management platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms") in accordance with the Indian Contract Act, 1872, and other applicable laws of India. If you disagree with any part of these terms, you may not access the Service. Your use of this Service signifies your acceptance of these Terms and your agreement to be legally bound by them.
2. Description of Service
RentBhai provides a comprehensive property management platform that includes features for property listing, tenant management, maintenance tracking, payment processing, and communication tools. The Service offers both free and paid features, with access levels determined by your usage patterns, account type, and selected plan. We offer various pricing models including free tier, freemium, subscriptions, one-time purchases, pay-per-use, and custom plans based on your specific needs. The Service is designed to comply with Indian real estate laws including the Real Estate (Regulation and Development) Act, 2016 (RERA) where applicable.
3. User Accounts
Account Creation
- You must provide accurate and complete information including valid identification
- You are responsible for maintaining account security and confidentiality
- You must notify us immediately of any unauthorized access or security breach
- You must comply with KYC (Know Your Customer) requirements as per Indian regulations
Account Responsibilities
You are responsible for all activities that occur under your account. You agree not to share your account credentials with third parties and will be held liable for any misuse of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purposes or in violation of Indian laws
- Violate any applicable laws including but not limited to RERA, rent control laws, and tax regulations
- Infringe on intellectual property rights protected under Indian Copyright Act, 1957
- Transmit malicious code, viruses, or engage in cyber crimes under IT Act, 2000
- Attempt unauthorized access to the Service or other users' accounts
- Harass, abuse, defame, or harm other users
- Use the Service to send spam or unsolicited commercial communications
- Impersonate any person or entity or misrepresent your affiliation
- List fake properties or provide false information
- Engage in money laundering or terrorist financing activities
5. Payment Terms
Service Fees and Free Features
RentBhai offers a range of free features available to all users, with additional premium features accessible through various payment models. Free features may be subject to usage limits, and access levels may vary based on your account activity, user type, and compliance with our Terms. Paid services are available through subscriptions, one-time payments, usage-based pricing, and custom enterprise plans. All fees for paid services are quoted in Indian Rupees (INR). You agree to pay all fees for the paid services according to the pricing model and plan you select. Fees for paid services are non-refundable except as required by law or as explicitly stated in these Terms. We reserve the right to modify the availability and scope of free features at any time.
Billing and Taxes
For free features, no payment is required, though certain usage limits may apply. For paid services, billing frequency and timing depend on your selected pricing model. Subscription plans may be billed monthly, quarterly, or annually in advance. Usage-based plans are billed according to actual usage. One-time purchases are billed at the time of purchase. We reserve the right to change our pricing, modify free feature limits, or introduce fees for previously free features with 30 days' prior notice.
6. Intellectual Property Rights
The Service and its original content, features, and functionality are owned by RentBhai and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws. All rights, title, and interest in and to the Service are and will remain the exclusive property of RentBhai.
7. User Content
You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the Service. You represent and warrant that you have all necessary rights to grant this license.
8. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which complies with the Information Technology Act, 2000, and its rules. Please review our Privacy Policy, which informs users of our data collection, use, and protection practices in accordance with Indian data protection laws.
9. Marketing and Communications
By creating an account, you agree that we may use your contact information to send you marketing communications, promotional materials, newsletters, and information about campaigns, services, and new features in compliance with the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCPR). You may opt-out of these communications at any time through your account settings or by clicking the unsubscribe link in our emails.
10. Disclaimers and Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the extent permitted by Indian law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We disclaim all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by applicable Indian law, RentBhai, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Service.
12. Indemnification
You agree to defend, indemnify, and hold harmless RentBhai and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable advocates' fees) arising out of or relating to your violation of these Terms or your use of the Service.
13. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.
14. Dispute Resolution
Arbitration
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 2015. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties.
Jurisdiction
The seat of arbitration shall be Kapurthala, Punjab, India. Subject to the arbitration clause above, the courts in Kapurthala District, Punjab shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the use of the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Kapurthala District, Punjab, India, to resolve any legal matter arising from these Terms.
16. Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations under these Terms if such failure or delay results from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
18. Entire Agreement
These Terms constitute the entire agreement between you and RentBhai regarding the use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
19. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the new Terms.
